Subject: NOTICE OF AGITATION AND STRIKE BY JOINT COUNCIL OF ACTION: CASE OF
              MAHARASHTRA & GOA CIRCLE

Sir,
            In this connection it is brought to your kind notice that Maharashtra and Goa Circle has issued notice of Agitation and strike by Joint Council of Action vide No P-IV/JCA/Agi/Strike/Sep-1 dated 19/09/2019 addressed to Shri Harish Agarwal (IPS) Chief Postmaster General Maharashtra & Goa Circle Mumbai GPOMumbai with copy marked to all concerned (photocopy enclosed)

The burning demands of the strike notice is relating to the following issues:-
            (1)   To fill up all vacant post of postmen, MTS, Mailguard and GDS
(2)   Immediate drawl of arrears of Notional Monetary Benefit to all Postmen, Mail Guard, Retired                 Postmen Mail Guard and all eligible Postal Assistant who were postmen at the time of      order on effecting date.
            (3)  Stop Nodal E-Commerce delivery
            (4)  Re-start of L-35 Section in R.M.S Wing
            (5)  Revised Wages of all daily wages staff as per Labour Commissioner’s latest order
     (6)  Issue of Sunday and Holiday Payment for GDS candidates who are working on vacant post         of Postmen & MTS
            (7)  All other legitimate demand which were earlier assured by the administration.

            In order to fulfill the  above demand the following phase-wise  three agitaional  program will be observed and finally indefinite strike, commencing from 21st Nov 2019 (Thursday),  if no action was taken to settle the demands given above:-

            1)  Proposed one day on duty Hunger Fast by all members on 15th October 2019
            2)  Proposed Agitation in front of All Division Offices in Maharashtra and Goa Circle on 18th                            October 2019 from 16.00 Hrs. to 18.00 Hrs.
            3)  One day token strike on 24th October 2019 (Thursday) from 6.00 A.M. to 12.00 P.M
4) If our legitimate demands were not settled which may result indefinite strike w.e.f. 21st        November 2019 (Thursday) for which department will be held responsible for bitter   consequences, if any.

           

            The altogether burning problems coupled with agitaional program  time and again of Maharashtra Circle as mentioned above were also brought to the notice of your office  vide this CHQ letters as under:-

         a) No P-IV/CHQ/14-Mumbai SD/2014 Dated 23rd July 2014
        (b) No P-IV/CHQ/Agitation Notice/2016 Dated 19th Sept 2016
        (c) No P-IV/CHQ/14/Agitation/Strike/2017 Dated 14th June 2017
        (d) No P-IV/CHQ/14/Agitation-Strike-1/2018-20 Dated 17TH July 2018
        (e) No P-V/CHQ/ 14/2018-20   Dated   07th April 2019
        (f) No P-V/CHQ/ 14/2018-20 Dated 30th April 2019.
   
            Despite protracted correspondence on every agitaional programe, the Chief PMG Maharashtra Circle always assured to fulfill the legitimate demands within stipulated period, but no action was taken to ease the situation.  Under the circumstances it has been decided to go on phase-wise programme and finally indefinite strike as per Maharashtra Circle Joint Council Action Notice as mentioned above have been served on 19th Sept 2019.

            The situation of Maharashtra Circle is becoming from bad to worse day by day because there is absolute apathy from the administration to come forward to wipe the tears of the aggrieved employees to look into the genuine problems and settle them immediately without betraying the assurance given by the administration.

            We would urge upon you to kindly intervene personally and direct the authority to get the problems, as mentioned above, solved on war footing in the interest of employees and department as well assuring peaceful working environment being the moral duty of the administration at all times. So far the indefinite strike proposed to commence from 21st Nov 2019, if no action to avert the situation, the department will be held solely responsible for bitter consequences.

            A line of reply for the action being taken in this regard will be highly appreciated and acknowledge this communication.

Gratuity is a bulk amount paid by the employer to his/her employee for his/her service at the time of retirement under the Gratuity Act 1972 .

What is Gratuity in Central Government Services?
Gratuity is a hidden savings of employees working in Government Service. Gratuity amount is calculated depends upon his period of service. The bulk amount of Gratuity is usually paid at the time of retirement. In some cases, it can be paid before as per existing rules.

How to calculate Gratuity?

Calculation of Gratuity = [ (Basic Pay + Dearness Allowance) x 15 days x Number of Years of Service ] / 26 Days.
Why calculating taken 26 Days instead of 31?
As per the labour law in India, the maximum working days in a month should be 26. Weekly holiday should be given to employees is compulsory.
What is the ceiling of Gratuity?
The 7th pay commission recommended to enhance the ceiling of Gratuity from Rs. 10 lakh to 20 lakh.

There are three types of Gratuity in force in Government services…

RETIREMENT GRATUITY,  
DEATH GRATUITY  &  
SERVICE GRATUITY
Retirement Gratuity
This is payable to the retiring Government servant. A minimum of 5 years’ qualifying service and eligibility to receive service gratuity / pension is essential to get this one time lump sum benefit. Retirement gratuity is calculated @ 1/4th of a months Basic Pay plus Dearness Allowance drawn on the date of retirement for each completed six monthly period of qualifying service.

There is no minimum limit for the amount of gratuity. The retirement gratuity payable for qualifying service of 33 years or more is 16 times the Basic Pay plus DA, subject to a maximum of Rs. 20 lakhs.

Death Gratuity

This is a one-time lump sum benefit payable to the nominee or family member of a Government servant dying in harness. There is no stipulation in regard to any minimum length of service rendered by the deceased employee. Entitlement of death gratuity is regulated as under:

5 years or more but less than 11 years
12 times of basic pay
Maximum amount of Death Gratuity admissible is Rs. 20 lakhs w.e.f. 1.1.2016
Service Gratuity
A retiring Government servant will be entitled to receive service gratuity (and not pension) if total qualifying service is less than 10 years.

Admissible amount is half months basic pay last drawn plus DA for each completed 6 monthly period of qualifying service. This one time lump sum payment is distinct from retirement gratuity and is paid over and above the retirement gratuity.

Government amends Rule 54 of CCS (Pension) Rules, 1972 -- PIB

On death of a Government servant while in service, the family is entitled to a family pension in accordance with Rule 54 of the Central Civil Services (Pension) Rules, 1972. The family pension was payable at enhanced rate of 50% of the pay last drawn for a period of 10 years, if the Government servant had rendered a continuous service of not less than seven years; thereafter the rate of family pension was 30% of the pay last drawn. In case the Government servant had rendered a service of less than seven years before his death, the rate of family pension was 30% from the beginning and family pension at enhanced rate of 50% of last pay drawn was not payable to the family.

The Government felt that the need for family pension at enhanced rate is more in the case of a Government servant who dies early in his career, as his pay at the initial phase of service is much less. The Government has, therefore, amended Rule 54 of the Central Civil Services (Pension) Rules, 1972 by a notification dated 19th September, 2019. As per the amended Rule 54, the family of a Government servant, who dies within seven years of joining service, will also be eligible for family pension at enhanced rate of 50% of last pay drawn, for a period of 10 years

The above amendment would be effective from 1st October, 2019. However, the families of Government servants who died before completion of service of seven years within 10 years before 1st October, 2019, will also be eligible for family pension at enhanced rates with effect from 1st October, 2019.

The benefit of amended provisions would be available to the families of all Government servants, including the personnel of CAPFs, in the unfortunate event of their death within seven years of joining Government service.
