Subject: Exemption from payment of examination fee and application fee in respect of Persons with Benchmark Disabilities. -reg.
The undersigned is directed to say that in a w.P. (Civil) No. 521/2008 with Civil Appeal No. 5389/2016, the Hon'ble Supreme Court, vide Judgment, dated 30.06.2016, inter alia, declared the Office Memorandum No. 36035/3/2004 - Estt.(Res) dated 29.12.2005, as illegal and in consistence with the Persons with Disability (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. This OM, among other, contained a provision for exemption from payment of application fee and examination fee in respect of Persons with Disabilities.
Thereafter, with the enactment of 'THE RIGHTS OF PERSONS WITH DISABILITIES ACT, 2016' and issue of notification titled 'THE RIGHTS OF PERSONS WITH DISABILITIES RULES, 2017', this Department has issued an Office Memorandum No. 36035/2/2017-Estt. (Res), dated 15.01.2018, regarding reservation for Persons with Benchmark Disabilities, in the posts and services of the Central Government. The said Office Memorandum dated 15.01.2018, however, does not contain any provision for exemption from payment of examination and application fee in respect of Persons with Benchmark Disabilities.
The issue has been deliberated upon at length in the Department and it has, now, been decided that the Persons with Benchmark Disabilities shall continue to be exempted from payment of application fee and examination fee, prescribed in respect of competitive examinations held by the Staff Selection Commission, the Union Public Service Commission, etc. for recruitment to various posts. This exemption shall be available only to such persons who would otherwise be eligible for appointment to the post on the basis of standards of medical fitness prescribed for that post (including any concession specifically extended to the Persons with Benchmark Disabilities) and who enclose with the application form, necessary certificate from a competent authority in support of their claim of disability.

CIRCULAR
Dear Comrade,
While remembering the Central Working Committee
Meeting held at Shimla (HP) on 26th-27th May 2019. During the CWC many resolutions were adopted
on different issues and resolutions for one day Dharna in front of the Chief
PMG offices across the country on demand of 10 points Charter of Demands was
also adopted. In order to highlight our demands on different pending agenda
items, notice was submitted to the department on 16th June 2019. Simultaneously all Circle Secretaries have
also submitted notice to the concerned Chief PMG for holding DHARNA 0n 07th
August 2019.
It is our pleasure to mention here that holding of
Dharna across the country before Chief PMG Office has been responded with great
pump and show by many circles to make aware the administration about our
pending demands .But the outcome as expected from all circles regarding holding
of the Dharna was not up to the mark for clear order issued from Directorate
for .non-grant of leave In this
connection the feedback from office bearers
and Circle Secretary on the
following points be furnished to this CHQ on Union letter head within fortnight
from the date of receipt of this letter.
It may please be noted that Comrades are requested to avoid feedback on
whatsapp or otherwise. Further suggestions on the charter of demands, if any,
are welcome for our further action. To make the DHARNA effective and powerful,
type of material, like pamphlets, placards, posters and other similar items,
used be intimated to ascertain your
exploring out on such material used.
(a) Total number of
members participated with details (i) number of
Working members, number of retired postmen/ MTS, number of Promotees PA/
SA, number of Pensioners .and GDS attended. If there was any problem faced during
holding of Dharna should also be intimated in a detailed.
In order to achieve settlement 10 points charter of demands,
the confederation of Central Government Employees and Workers have given the
call to all of us to observe Nation Wide Protest and struggle programmes as
below:-
(a) Phase I
: 05th Sept 2019 (Thursday): All Circle Secretaries/Divisional
Secretaries will submit memorandum with Charter of demands to Hon’ble Prime
Minister, Cabinet Secretary, Heads of All Departments and copy of memorandum be
also submitted to all Heads of Offices at State/District Level holding mass
demonstration
(b) Phase
II 15th October 2019 (Tuesday): Mass Dharna in front of all
important offices and at all major centers at State/District level.
National
Conference will be held at Nagpur (Mah) from 07th Feb 2020 to 08th
Feb 2020. The delegate fee is fixed as Rs 1,000/-. The number of delegates to
be allotted by the Confederation for this CHQ will be intimated on hearing from
CCGE&W.
To observe 51st Anniversary as Martyrs day remembering those valiant fighters for one day on 19th September 2019 holding meetings, demonstrations, flag hoisting and slogan shouting at all level to recall One Day All India Strike of 19th September 1968 of Central Government Employees demanding need based minimum wages and 100% neutralization of D.A. The Central Government unleashed the brutal force to suppress the strike. In the strike 17 comrades lost their lives. Thousands were terminated suspended and put into jail. Recognition of unions/Federations was withdrawn. The Circle Secretaries will intensify the programme motivating Divisional Secretaries and other members in touch.
Call of Postal Joint Council of Action for the following
progrmmes
1stPhase programme for
submission of memorandum and 2nd Phase organizing one Day
Dharna at Divisional level on 21st August 2019 have been carried out
successfully.
3rd Phase: To organize one day
Dharna at Circle level across the country on 11th September 2019 be
organized effectively over our long pending demands. Maximum number of participants
from divisional and specially circle office bearers to intensify the progrmme
to make aware the administration concern over the genuine pending demands.
Detail of the report be sent to this CHQ for publication in our monthly
journals.
4th Phase: one day Dharna at
New Delhi on 04th October 2019 in a very befitting way to make
concern of the department as was done on 07th August 2019. Maximum participants would show our
organizational strength to invite the attention of the administration over our
pending demands.
Federal Council of NFPE is schedule
to be held at Vrindaban, Mathura (UP) from 25.11.2019 to 27.11.2019. Delegate
fee is fixed as Rs 1500/- for visitors/delegates. Number of delegates to be
allotted will be intimated on hearing from NFPE.
NB: As regards payment of Rs 3,050/- to postmen and Mail
Guards, Delhi Circle (DAP) has issued order to make
payment of all eligible beneficiaries with benefit provided in the 5th
CPC (including benching of increment). Vide DAP Delhi letter No Pen
-1/Fixation of pay-postman/Mail Guard/1996 dated 07/08/2019.
