                The meeting of the JCM  Standing Committee was held on 18/12/2012 at 1500 hrs. in Dak Bhavan, under the chairpersonship of Member (P).  The following were present:-

                The Chairperson welcomed all the members and permitted to take up the agenda.  After detailed discussions on each item, the following decisions were taken:-

5.	Request for discontinuance of the practice of obtaining fidelity / security bond from the employees handling cash.	Secretary (Posts) ordered that the security bonds may be continued for the time being॰	Item closed.
6.	Protection of pay of the defunct scale of PO & RMS Accountants who opted for general line under Directorate letter No. 2-22/88 - PE I dt. 01.12.92.	The issue was examined in consultation with IFW and it was revealed that even in the case of Shri Natha Singh, the clarification was not implemented. The issue of Shri Natha Singh has since been referred to Punjab Circle and further action in the matter will be taken on receipt of compliance from Punjab Circle on the observations raised by them. 7.	Revision of Cash Allowance to the SPMs handling cash in the absence of treasurer.	The proposal has been referred to DOPT and Department of Expenditure.	DDG(Estt)
8.	Anomaly in fixation of Pay in respect of the officials promoted on 01.01.96 under BCR Scheme.	The proposal has been rejected by DOPT.	Item closed.
9.	Conveyance of cash with police escort- Problems there on.	(a) Revision of line limits is being looked after by a committee of officers whose recommendations are awaited. (b) Circle Heads have already been addressed to explore the possibilities of providing security guards in the Post Offices in sensitive areas and take appropriate action.	DDG(PO&CP) Item closed.
10.	Ensuring the standard of residential accommodation to the SPMs provided with attached Quarters.	It was informed providing of post attached quarters to Postmaster or Sub Postmaster of a post office is a service condition due to the necessity of ensuring continuous delivery of mail irrespective of external or physical conditions, security of cash and valuables kept in the treasury etc.  Heads of Circles are empowered to decide about de-quarterization. 11.	Fixing Norms/ Time Factors to Postal Stores Depot; Circle Stamp Depot & creation of establishment.	It was explained that the committee is re-examining the matter.	DDG (Estates & MM)
12.	Payment of Special Allowance to the staff working on MPCMs.	Directorate has already notified position to all Heads of Circles that the re-introduction of MPCM allowance is not possible in view of the grant of higher pay scale of Rs.4,000 – 6000/- as per the 5th CPC.	Item closed.
13.	Stop harassing staff on contributory factors for simple and flimsy reasons by misusing the provision of ‘unbecoming of Government Servant’ deviating the ruling contained in Volume III, FHB etc.	It was made clear to the Staff side in the meetings on 10/12/1/2012 that it would not be possible to issue any speaking order as each case needs to be decided on its merits and further that the channels of appeal, petition and review petition are also available to the official concerned. 14.	Recovery of alleged overpayment of pay and allowances to postman on account of fixation from the officials of Accounts branches of HPOs	It was informed that based on the judgement of CAT, speaking order has been issued and there is no change in the stand taken by the Department.	Item closed.
15.	DRAWAL OF PAY TO SENIOR BCR OFFICIALS IN HSG I POSTS AS THE PAY SCALES OF HSG II & BCR IS ONE AND THE SAME & SETTLEMENT OF EARLIER OFFICIATING CASES OF TAMILNADU, WEST BENGAL & OTHER CIRCLES AS ONE TIME MEASURE	Clarification has already been issued to all concerned.	Item closed.
16.	Tenure posting of officials in Single & Double Handed post offices – request to withdraw the conditions	Orders have already been issued vide No.8-4/2005-Inv. dated 12/01/2012.	Item closed.
17.	Restriction in posting of SPM due to minor penalties / CR entries.	Action has already been taken.	Item closed.
18.	Allowing to appear in the Departmental Exam like IPOs – case of physically handicapped officials	It was informed that the matter is under consideration in consultation with Ministry of Social Justice, the nodal ministry of notification of identification of posts for persons with disabilities. 19.	Enhancement of Split Duty Allowance.	Action has already been taken.	Item closed.
20.	Transfer of all HSG I Posts to General line	The proposal has been taken up with UPSC.	DDG(P)
21.	Payment of honorarium to supervisors & Staff of Divisional offices for processing of PLI and RPLI proposals.	It was informed that the case for removal of ceiling of Rs.4,000/- cannot be agreed as it is within the purview of DOPT and Department of Expenditure.  The proposal of giving incentive may be taken up by the Staff side with PLI Directorate afresh. 22.	Grant of OTA/Excess Duty Allowance to the SPMs working in single/Double handed Post offices.	Some quarries have been received from DOPT. The matter is being taken up again with them.	DDG(Estt)
23.	Counting the training period for benefits of promotion under TBOP / BCR scheme	Department of Legal Affairs has sought some clarifications.  After obtaining the information from the Circles the case will be examined in consultation with Department of Legal Affairs.	DDG( P)
24.	Holding of examination for filling up to posts of AMM in MMS	The matter is being examined.	DDG(P)
25.	Holding of DPC for filling up the posts of Deputy Manager MMS	DPC will be convened to fill up the posts.	DDG(P)
26.	Appointment to the grade of Supdt. Stg. In RMS	It was informed that posts will be located / identified in consultation with Circles and will be filled after completing the procedural formalities.	DDG(P)
27.	Acute shortage of ‘C’ Bags.	The proposal of procuring canvass bags will be examined subject to availability of funds.	DDG(Estates & MM)
28.	Implementation of recommendation of the 5th CPC with regard to payment of cash handling allowance to treasurers and Asst. Teasurers in Post offices.	It was informed that the proposal will be sent again to the Ministry of Finance for consideration.	DDG (Estt)
29.	Allot 19% Group B vacancies for General line and permit all Group C official in Postal, RMS, Admn. and Postal A/Cs with minimum 20 years of service to appear in the exam by dispensing with present reservation of posts to RMS & Admn. Staff.	Elaborate proposal will be submitted by the Staff side to Director (SR).  The same will be examined by the DDG(Estt) and DDG(P).	DDG(Estt)/ DDG(P) / Director(SR)
30.	Anomaly in the preparation of PA gradation list. Date of confirmation should not be taken now and date of appointment be taken for construing seniority. Fixing seniority based on the date of confirmation in unconstitutional and discriminatory and dropping of confirmation examination.	It was explained that the proposal is specific to Tamil Nadu Circle.  They has already been addressed.	Item closed.
31.	Relaxation of educational qualification in respect of widow applicant for compassionate appointment.	Clarification received from the DOPT has already been circulated vide No.37-34/2009-SPB-I/C dated 19/04/2012.	Item closed.
32.	Request for correct identification of Speed Post Hubs.	It was decided that joint visit (MM and Staff side) will be made to arrive at confirmation of mail at Kurnool and Guntakul for deciding L1 / L2 issue.	CGM (MB) and Staff Side.
33.	Request to extend the Station Tenure to Senior Manager Cadre in MMS.	Department has already issued Rotational Transfer Guidelines vide letter No.141-91/2012-SPB-II dated 02/04/2012 (Copy enclosed), which also cover MMS cadre.  On the basis of these guidelines, necessary information from all the Circles will be called for shortly and further action will be taken in consultation with MV Branch of the Department. 34.	Pay protection to employees who seek transfer to a lower post under FR 15 (a)/transfer under Rule 38.	The proposal will be taken up by the Staff side directly with DDG(PAF).	Item closed.
35.	To fill up the time scale Driver Post at MMS.	The position was explained to the JCM Members.	Item closed.
36.	Construction of Departmental Buildings for Postal Accounts Offices at Hyderabad, Trivandrum and Patna.	It was informed that the proposal will be considered for construction during the 12th Plan period subject to availability of funds and approval of Expenditure Finance Committee.	DDG (Estates & MM)
37.	Problems arisen subsequent on Centralization of Tax related work at HO in SB Branch.	It was informed that e-filing is to be done by DDOs as per existing IT rules.	Item closed.
38.	Posting of in charge of BPC	Guidelines have been issued to all Heads of Circles vide this office O.M. No.16-10/2011-BD&MD dated 28/06/2012.  Copy enclosed.	Item closed.
39.	Irregularities in the accounting procedure in Post Offices – case of Delhi Circle.	The Head of the Circle is aware of this fact and on CPMG’s direction approximately vouchers of more than 1.75 crores have been sanctioned.  All Units have been directed by the Circle to take necessary action to liquidate this amount at the earliest.  A weekly monitoring is being done for liquidation of pending amount by the Circle. 40.	Removal of age limit for appearing in IPO exam.	Discussed and not agreed.	Item closed.
41.	Providing Security to cash overseers.	(a) Revision of lane limits is being looked after by a committee of officers whose recommendations are awaited. (b) Circle Heads have already been addressed to explore the possibilities of providing security guards in the Post Offices in sensitive areas and take appropriate action.	Since the item is same as Item No.9, this item, i.e. Item No.41 is closed.
42.	Weight and size limit of express post parcels delivery of by Postmen.	Instructions on the subject have been reiterated to all the Head of Circles vide letter No. 14-06/2010-BD&MD dated 25/04/2012.	Item closed.

GDS BONUS

NFPE HAS GIVEN THE CORRECT NEWS

MAHADEVAIAH GROUP FLASHED THE FALSE NEWS DELIBERATELY ON 10^THDECEMBER 2012 TO SABOTAGE THE 12^TH DECEMBER 2012 STRIKE

MAHADEVAIAH GROUP GDS UNION HAS NOT GIVEN STRIKE NOTICE FOR 12^THDECEMBER 2012 STRIKE

1.   On 10^th December 2012 when all are actively campaigning for the success of the 12^th December 2012 joint strike, the Mahadevaiah Group GDS Union flashed the following news in their website -

“FLASH AND GLAD NEWS – BONUS FILE CLEARED BY FINANCE TODAY”

They deliberately gave publicity to this false news just to create confusion among the GDS and to sabotage the 12^th December strike.

2.   After 12^th December strike NFPE put the following news in its website.

“Regarding GDS Bonus the propaganda made by Mahadevaiah Group GDS Union is totally false. Finance Ministry has not approved the proposal for raising the GDS Bonus ceiling to Rs. 3500/- but returned the file without approval.”

(This news item is still in the NFPE website and anybody can verify it.)

3.   Now, after the 12^th December strike, the Mahadevaiah Group GDS union openly admitted that the Bonus File is not cleared by Finance, but the File was returned to Postal Directorate without approval. Now in the website of Mahadevaiah group the following lines are written.

“FINANCE MINISTRY HAS SENT THE FILE BACK TO THE DEPARTMENT OF POSTS FOR SOME CLARIFICATION”

4.   Now let the readers and employees judge, who is right and who is wrong. Who is giving correct news and who is spreading false news. NFPE has given the correct news and Mahadevaiah group has published false news and subsequently corrected it after NFPE putting the correct news. They have lost their credibility and they are trying to cover up their ill motivated false propaganda by putting the blame on NFPE.

5.   It is an admitted fact that Mahadevaiah group GDS Union has not given strike notice for the 12^th December strike. They tried their best to sabotage the 12^th December strike. Their leaders have demanded the administration to take disciplinary action against those employees who participated in the 12^th December strike. NFPE has already published one such letter in its website and anybody can read it.

6.   Can Mahadevaiah group GDS Union prove that they have given strike notice to the Secretary, Department of Posts, for the 12^th December strike? Can Mahadevaiah group GDS Union deny that their leaders have not written any letter to the administration to take disciplinary action against those participated in the 12^thDecember strike? Can Mahadevaiah group deny that the letter written to the administration by their leader published in NFPE website is a false one? No, they cannot.

7.   The issue of raising Bonus ceiling of GDS from 2500/- to 3500/- was an important item in the memorandum submitted by Confederation to the Hon’ble Prime Minister of India, Finance Minister and Cabinet Secretary during the Parliament march and also in the strike charter of demands of the 12^th December 2012 strike served to the Cabinet Secretary and the Secretary, Department of Posts. Many MPs irrespective of political affiliation and also Union Cabinet  Ministers have written letters to Hon’ble Prime Minister to consider the demand of the Confederation. Further both NFPE and FNPO has jointly demanded the Government to raise the bonus ceiling of GDS. The Minister of States for Communications and the Secretary, Department of Posts, has assured the JCA leaders that the case will again be forwarded to the Finance Ministry with favourable recommendations. The Secretary, Department of Posts has informed the JCA leaders that Cabinet Secretary was also appraised of the matter. The efforts made by NFPE, FNPO and Confederation and the mass-scale participation of the employees (Departmental as well as Gramin Dak Sewaks) in the 12^th December Strike has its own impact.

8.   The attempt of the Mahadevaiah group to project themselves as the only union for the GDS was thoroughly exposed in the 12^th December strike and more than 80% of the GDS joined the strike call given by NFPE & Confederation, inspite of the fact that Mahadevaiah Group GDS Union has not given the strike notice and has not conducted any campaign programme to make the 12^th December strike a success. More and more GDS leaders from Mahadevaiah group including All India office bearers are joining the newly formed AIPEU GDS (NFPE).  In the 12^th December strike, the unity of the Departmental employees and Gramin Dak Sewaks was restored and those who are trying to divide the GDS and Departmental employees cannot continue their nefarious game any more.

9.   ACTUAL POSITION OF GDS BONUS

As already exhibited by NFPE in its website, the GDS Bonus file was not cleared by Finance Ministry but returned to Department of Posts without approval. The reason stated by Finance Ministry is as follows -

Up to 2006 GDS were also paid equal Bonus on pro-rata basis along with regular employees. The One-man Committee (Nataraja Murthy Committee) appointed by Government has recommended that GDS are not eligible for equal bonus with regular employees and the payment made up to 2006 was unjustified as per the commission’s recommendations. This recommendation of the Nataraja Murthy Committee was accepted by the Government and Postal Board. Accordingly it was decided not to raise the Bonus ceiling from 2500 to 3500. After that the Department of Posts has not undertaken any fresh study to justify the payment of equal Bonus (3500) to GDS. Postal Department should conduct a fresh study by another committee and submit revised proposal justifying the payment of equal bonus to GDS. Such revised proposal, if any, submitted after fresh study will be examined by the Finance Ministry and if found justified will be considered for implementation from the next financial year i.e., 2013-2014. Regarding this financial year’s Bonus Finance Ministry is not ready to reconsider it. That means the Bonus for the current financial year (2012-2013) stands rejected. This is the stand of the Finance Ministry.

10.  Now the Department of Posts has constituted a Committee of officers to make fresh study of the case and submit fresh proposal to the Finance Ministry for consideration and approval. The Postal Board has assured the JCA (NFPE + FNPO) that the study will be completed quickly and fresh proposal will be submitted to Ministry of Finance. Definitely the JCA will take necessary follow up action.

11.  The anti-NFPE minded leaders of the Mahadevaiah group GDS Union should clearly understand that their repeated attempt to divide GDS employees and Departmental employees is not going to work any-more. GDS will stand with NFPE. NFPE will never misguide the employees, but will always stand by the truth. Please remember that

CONFEDERATION HAS WRITTEN TO THE GENERAL SECRETARY OF AIRF

REQUESTED FOR CONVENING OF THE MEETING OF ALLORGANISATIONS IN NATIONAL COUNCIL JCM FOR FORMING A JOINT COUNCIL OF ACTION TO PURSUE DEMANDS LIKE 7th CPC.

Dear Comrade,

                I may invite your kind reference to the letter on the subject I had sent you earlier, wherein I had requested you to take initiative in convening a meeting of the leaders of all organisations participating in the JCM.  JCM as a negotiating forum, as you are aware, has virtually come to a halt.  It was in May, 2010 that the National Council met on the last occasion.  Barring Railways, Defence and to some extent the Postal, the Departmental Councils of other Ministries/Departments have not been meeting since 1995.  In some departments, these councils have ceased to exist as the Government on one pretext or the other has not been granting recognition to the Service Associations, even though they had complied with all the conditions stipulated in the CCS(RSA) Rules,  1993.  Most of these organisations having only a few thousand members are incapable of forcing upon a decision in the matter through agitation. 

                Though we had been raising this issue on a number of occasions and despite solemn assurances held out by the official side, nothing tangible has come about.  It is unlikely that the Government will consider revival of the negotiating forum unless we jointly demand effective functioning of the JCM at all levels and follow it up with joint agitational actions.

                As you are aware, the 6^th CPC made very retrograde recommendations in respect of Group B,C and D employees.  The Pay band prescribed for the above category of employees was equal to the pay+DPA +DA i.e. 1.86 times of the minimum of the basic pay of the lowest in the group, whereas the pay band for Group A posts was fixed by multiplying their prescribed basic pay by a factor ranging from. 2.2 to 2.63 (S.30, S.25).  Similarly grade pay was to be 40% of maximum of pre-revised pay scales whereas in the case of Group A officers it was later revised to 44 to 49%.

                Several anomalies were raised by us in the National Anomaly Committee.  After procrastinated discussions, except cosmetic changes, none was settled.  I have now been informed that even what was agreed to in the last meeting of the National Anomaly Committee, has been turned down by the Finance Ministry.  In all through the discussions at the Anomaly committee meetings, you must have noticed that reasoning has been the casualty. 

                The high ranging inflation in the economy especially in the last 3 years has caused soaring rise in the prices of all essential commodities especially food items.  Major portion of the salary of the low paid workers is consumed for accessing the food items.  The prices adopted by the 6^th CPC in determination of the minimum wage have now registered an increase of more than 162% and the DA compensation is just 72%.  This apart, the recommendation of the 6^th CPC being effective from 1.1.2006 has been in vogue for 5 years as on 1.1.2011.  In the case of all Public Sector undertakings, the Govt. has now agreed to effect wage revision after every five years.  We have, therefore, to demand the setting up the 7^th CPC without any further delay  It has been our experience, as you will agree with me, that the Government had agreed for setting up pay commission for wage revision only when we unitedly placed the demand and backed up the same with recourse to strike action. 

                There are other issues too which brooks no delay in bringing about settlement viz. the implementation of arbitration awards, merger of DA with pay, withdrawal of the PFRDA Bill, compassionate appointmentsetc.etc.

                The AIRF is the biggest Federation representing the largest number of Railway workers amongst the Central Government employees and naturally we expect you to kindly take initiative in convening a meeting of the leaders of all organisations participating in the JCM to form a JCA to pursue the long pending issues demands of Central Government employees.  I shall also be grateful for favour of your considered view in the matter.

Sub:"incentive increments to sports persons for outstanding sports achievements, National and International levels.

Ref: Your letter M No. 6/2/2008 Pay I dated August, 2008. 

Kindly refer to the above cited letter.

The practice of giving incentive increments to the sportsperson who excel was to be replaced with lump sum grant. Views were called for by the Department of Personnel from all Ministries/Departments as also individuals.  We have felt that there was no need to change the existing system as we found to be a better financial benefit in the longer run.  Lumpsum grant however, large it may be will not help the persons who have worked hard in their youthful days. However, we felt that the sportsperson must have a say in the matter. 

More than 4 years have passed now.  No views from the Ministries or individuals seem to have been received by the Department of Personnel. Or if received it has not been made known. 

It has been represented to us that in the name of changing the entire scheme itself, the incentive increment system was in vogue was discontinued with effect from 1.1.2006.  As you are aware, the scheme was introduced in Government service with effect from 1985 with a view to attract the sports personnel to choose the Government service and more so to encourage them so that they can acquit themselves creditably.  

We, in the circumstances, request that the incentive scheme may be revived and made effective from 1.1.2006. In the case of all allowances which are incentive in character, the Government had doubled the amount after the 6^th CPC.   

The action taken in this regard may please be intimated to us.

CONDUCT PROTEST DEMONSTRATIONS IN FRONT OF

ALL CIRCLE/REGIONAL/DIVISIONAL OFFICES ON 28-12-2012

               As per Government of India orders on Downsizing of Central Government Services, Screening Committee for filling up/aboliotion of posts was constituted in the year 2001 and Annual Direct Recruitment (ADR) plan was approved by the Screening committee for each year from 2001 to 2008.  Screening Committee cleared only 1/3rd vacancies for direct recruitment and balance 2/3rd posts were ablished as per its recommendations.

               Accordingly Department of Posts abolished 2/3rd vacant posts from 2001 to 2004.  Regarding the abolition of 2/3 rd vacant posts from 2005 to 2008, Postal Department & Communication Ministry requested Finance Ministry to grant exemption to Department of Posts from abolishing the vacant posts from 2005 to 2008, as it is an operative Department dealing with the general public and customers.  2/3rd posts earmarked for abolition from 2005 to 2008 are kept vacant (but not abolished) pending decision of the Finance Ministry.

               The ban on recruitment was lifted and the Screening Committee was abolished in the year 2009.  Government of India issued orders to fill up all vacant posts for the year from 2009 onwards.  Accordingly, Department of Posts, issued orders to fill up all vacancies for the year 2009 and 2010.  Orders are also issued to fill up all vacant posts for the year 2011 and 2012.  But, at the same time, Directorate issued clear instructions to all Chief PMGs that posts kept vacant for the year from 2005 to 2008 should not be filled up under any circumstances but should be kept vacant. (for abolition).

          Finance Ministry has now made it clear that no permission or exemption will be granted to any department including Department of Posts to fill up the posts kept earmarked for abolition as per the Screening Committee recommendations.  Accordingly Department of Posts has now issued orders to abolish all the 2/3rd vacant posts (Total 17093 posts for four years) for the year 2005 to 2008.
